These Supplemental Terms are legally binding terms governing Your use of Mobile Testing Services.
These Supplemental Terms form an integral part of the Master Subscription Agreement and/or the online Order by which You ordered the Mobile Testing Service. Copies of the Master Subscription Agreement in effect from time to time are posted at www.keynote.com/legal.
If You are accepting these Supplemental Terms on behalf of a company or other legal entity, You represent that You have the authority to bind such entity and its Affiliates to these Supplemental Terms, in which case “You” and “Your” shall refer to such entity and its Affiliates. If You do not have such authority, or if You do not agree with these Supplemental Terms, You must not accept these Supplemental Terms and may not use the Mobile Testing Services.
These Supplemental Terms were last updated on February 12, 2015.
Capitalized terms used in these Supplemental Terms have the meanings given to them below, or if not defined below, then the meanings given to them in the Master Subscription Agreement, as applicable, between You and Us.
“Mobile Testing Services” means the Keynote Services offered by Us under the names Mobile Testing Free, Mobile Testing Pro, Mobile Testing Pro Unlimited, and Mobile Testing Enterprise Services (previously known as “Test Center Developer” and “Test Center Enterprise”).
“Master Subscription Agreement” means the Keynote Master Subscription Agreement as posted at http://www.keynote.com/legal/subscription, or the subscription agreement executed by You and Us.
2. PUBLIC MOBILE TESTING DEVICE USAGE.
We offer Mobile Testing Services that provide remote access to a public cloud of real devices offered in the United States and other select countries. We will make reasonable efforts to automatically delete all Application Data on public mobile testing devices between successive test sessions (i.e., in the time between one user releasing a device and another user accessing the same device); provided however, that protection and removal of all Application Data from a public mobile testing device is ultimately Your responsibility. We will not be liable for any breach of confidentiality or leakage of Application Data due to any Application Data knowingly or unknowingly being left on a public mobile testing device. Typically, only one user may access a public mobile testing device at a time and no other user may remotely view a public mobile testing device screen. If two or more public mobile testing devices are interacting with each other (for example, playing a multi-player game, in a video conference, or otherwise engaging in networked communication over Wi-Fi or a cellular network, etc.), it is Your responsibility to ensure that all relevant public mobile testing devices have been engaged in the session, so that another user may not access them and view any of Your Application Data.
3. PREPAID ACCESS HOURS.
Hours are accrued in six (6) minute increments (or 1/10th of an hour). Any unused hours remaining at the end of the Subscription Term automatically expire and may not be used by You or any User to access any Mobile Testing Services after the expiration of the Order’s Subscription Term.
4. PREMIUM CONTENT.
Premium content charges include any fees incurred through utilization of a mobile testing device, above and beyond, standard voice and data airtime plan fees. This can include paid downloads, messaging subscriptions, donations, etc.
Due to the pass through nature of these premium content charges and the carrier network billing cycles, it may take several months for these charges to appear on Your account and in some cases will be billed after the completion of the Subscription Term.
5. DEVICE PACKAGES.
For Mobile Testing Pro Orders with device packages, You may add device packages at any time from the Edit Subscription page in the Keynote portal or by emailing a request to firstname.lastname@example.org. Additional device package charges will be prorated for the remainder of the Subscription Term.
